Terms of Service

These terms apply when you use wemilystudio.com, fill out one of our questionnaires, send us a message, or book a call. By doing any of these, you agree to these terms. If you do not agree, please do not use the site.

Who we are

Wemily Studio is a brand of Wemily LLC, a North Carolina limited liability company. “We”, “us” and “our” mean Wemily LLC. Contact: partnerships@wemilystudio.com.

Our services and prices

We design and build websites for businesses, and we offer Google Business Profile setup, an SEO package and an optional monthly plan. Prices on this site are in US dollars and describe our current offer.

Paid work is governed by a separate written service agreement. Work beyond the free homepage concept starts only after you accept the service agreement and pay the 50% deposit. If anything on this site differs from your signed service agreement, the service agreement wins.

Questionnaires, free homepage concepts and quotes

• Filling out a questionnaire is free and does not oblige you to buy anything.

• We may decline to prepare a homepage concept or quote, for example if your project is outside what we currently offer.

• A homepage concept and a quote are not a contract. A quote describes the pages and features it lists.

• A homepage concept stays our work until you buy. You may not copy it or use it for your own site unless you hire us.

• When you send us text, logos, photos or other material, you confirm you have the right to share it, and you allow us to use it to prepare your concept, your quote and, if you hire us, your website.

• Please do not send passwords, payment card numbers, government ID numbers, or health or medical information through our forms. We never ask for passwords.

Text messages

• Opt-in only. We text you only if you tick the optional “Text messages” box on our questionnaire or our “Yes, I’d like to go ahead” form. The box is never ticked for you. Consent is not a condition of purchase.

• What we text about. Your free homepage concept, your quote and your website project, for example that your concept is ready, a reminder, or a follow-up.

• How often. Message frequency varies with your project.

• Costs. Msg & data rates may apply under your mobile plan. We don’t charge for our texts.

• Stop or get help. Reply STOP at any time to stop our texts; you’ll get one message confirming it. Reply HELP for help, or email partnerships@wemilystudio.com.

• Delivery. Mobile carriers are not liable for delayed or undelivered messages.

• Your number. If your mobile number changes or you give it up, tell us or reply STOP, so we don’t text someone else.

• Privacy. How we handle your number and your consent: see “Text messages” in our Privacy Policy. We never share or sell your mobile number or opt-in data to third parties for marketing.

Using this site

You agree not to:

• use the site or our forms for anything unlawful, misleading or harmful;

• send spam, malware or automated submissions;

• submit someone else’s personal information without their permission; or

• try to break, overload or get unauthorized access to the site or the services behind it.

Our content

The text, design and graphics on this site belong to Wemily LLC or are used with permission. You may view and share links to our pages, but you may not copy the site or its content for commercial use without our written permission. Client projects shown in our portfolio belong to their owners and are shown with their permission. Demo builds are labelled as demos.

Other services and links

Our questionnaires run on Tally, our booking page runs on Google Calendar, and our site is hosted on Framer. Some pages link to other websites, including client sites. Those services and sites have their own terms and privacy policies, and we are not responsible for them.

No guarantees

We work hard to keep the site accurate and available, but we provide it “as is” and “as available”. We do not guarantee that the site will always be available or error-free. We do not guarantee search rankings, Google Business Profile verification (Google controls verification), or any business result from a website or service.

Limitation of liability

To the fullest extent the law allows, Wemily LLC is not liable for any indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of this site, our questionnaires, a free homepage concept or a quote. Our total liability for any claim about this site is limited to $100.

Indemnity

If you misuse the site or send us material you do not have the right to share, and that causes a claim against us, you agree to cover our reasonable costs of that claim.

Governing law

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute about these terms will be handled in the state courts located in Person County, North Carolina, or in the United States District Court for the Middle District of North Carolina.

Changes to these terms

We may update these terms. We will post the new version on this page and change the effective date above. Using the site after a change means you accept the new terms.
